The Amendment to the Labelling of Fragrance Allergens

Back in early December 2024, we provided an urgent reminder article on the Amendment to Labelling of Fragrance Allergens in Cosmetic Products for the EU. With the adding of 56 allergens to the original list of 24 allergens (initially 26, but two are now banned) to now make 80(+) and their groupings.

It is highly recommended that this be made a priority to review all your registered products with fragrance within their formulations.

EU CLP Updates

In the EU, the ever-changing Regulations are increasing the focus for cosmetic companies and ingredient suppliers.

The changes to be aware of are:

  • Product labels will need to be designed to be easier to read with a minimum font size and typeface, line spacing and black copy on a white backdrop.
  • There will be more possibilities for companies to office labelling on a fold-out label, which must contain specific information on the front, inside and back of the label.
  • Product labels in e-commerce and advertising will need to adhere to stricter requirements for chemical substances. For example, a ban on claims like “non-toxic” and “ecological”
  • The revised regulation also includes possibility of digital labelling for additional information.
  • The classification of complex substances will be subject to clear rules that will come into force from 1st July 2026.
  • Suppliers in the EU will need to ensure the compliance of substances sold online by any economic operator/s they work with outside the EU.
  • There are new rules and conditions for refillable and buy-in-bulk products.
  • There will be an update of annexes for substances that already meet the criteria for new hazard classes.
  • Several measures for regulators to encourage the faster adoption of harmonised classifications in future.
Important Dates to remember for EU CLP:
  • New changes to the majority will come into force from 1st July 2026
  • The rest will come into play 1st January 2027.
New: EU Green Claims Directive (in draft currently)

The proposed directive would set detailed rules on substantiating and communicating explicit environmental claims about products, in business-to-consumer commercial practices. The requirements included in the proposed directive would apply to specific aspects of explicit environmental claims and would take precedence over the requirements of Directive 2005/29/EC concerning those aspects, in case of conflict.

Additional changes to the UK Regulations that could apply to you:
UK EPR – Extended Producer Responsibility for Packaging

The EPR proposals are that packaging producers will be responsible for the entire cost of recycling the household packaging they place on the market, including the cost of collection treatment, and recycling minus the value received for the recycled materials.

Extended Producer Responsibility (EPR) requires packaging producers to fund the full cost of managing packaging waste. This includes collecting, sorting, treating and recycling. Brand owners and producers will now cover these costs through local councils – costs that previously fell to taxpayers.
